The first sport arbitration center in Sudan 

IACS

The International Arbitration Center for Sports  is a private and independent Sudanese institution that was established in Khartoum in 2022 under the laws of the Ministry of Justice (Resolution No. (345) of the Sudan Minister of Justice) and Registration Certificate No. (164089). The institution works in the field of dispute resolution and disputes related to sports through arbitration or any of the alternative means of resolving disputes. It is considered an independent and neutral body, and has the legal personality and financial and administrative independency.

President's speech

Through our membership in the Federal Youth and Sports Laws Review Committee in 2014, we recommended that there be an independent and neutral body specialized in resolving sports disputes in Sudan, which was not achieved in the new Youth and Sports Law of 2016.

As a result, the law failed to settle the sports dispute in the Sudanese Football Association in 2016 due to the lack of this independent and neutral body and because of the failure to implement the recommendation of the Ministerial Legal Committee (of which I was honored to be a member) regarding signing the cooperation agreement and establishing an independent and neutral body to resolve sports disputes in Sudan.

The conflict over sports authority in Sudan between the government and the private sports sector on the one hand and the private sports bodies on the other hand created ongoing disputes that caused the suspension of sports activity and its failure to develop due to the lack of a proper mechanism for settling sports disputes in Sudan.

The idea began to establish a center for sports arbitration in Sudan, and its formation began in 2017, and then it was officially approved by the Sudanese Ministry of Justice in 2022 under the name of the International Center for Sports Arbitration.

From the first moment, we have been keen to establish the rules and foundations of justice and absolute transparency in all sports disputes in order to give everyone their due rights, and to reach the best practices in our sports sector, with all the different names that fall under it, whether government institutions, bodies, clubs, or individuals and people belonging to that sector.

We seek for the Center to have a sublime role and its noble mission in raising the level of our sports and providing an exemplary environment in which justice prevails. We pledge to everyone to make every effort to provide the best solutions and results emanating from the Center’s laws, statute, and procedural rules.

In conclusion, I would like to emphasize the commitment of the International Center for Sports Arbitration to carry out its tasks and duties towards all parties and to stand at the same distance from everyone in order to translate the vision and objectives of the Center in spreading and establishing the culture of sports arbitration and encouraging resorting to it in all sports disputes.

Our Objectives

The Center seeks and works to achieve the following objectives: –

  1. Speedy settlement of sports disputes
  2. Spreading the culture of sports arbitration and alternative means of resolving disputes
  3. Qualifying, preparing and accrediting arbitrators, conciliators and mediators in the sports field.
  4. Strengthening relations with the authorities concerned with sports arbitration in the country and abroad and encouraging cooperation and partnerships with them
  5. Participation in relevant sports forums

Our Activities and Practice area

Within the framework of achieving its objectives, the Center carries out the following activities:

  1. Resolving local and international disputes through arbitration or other means of resolving disputes at the request of the parties.
  2. Providing legal consultations and services in the sports field.
  3. Providing technical advice and consultations in drafting local and international contracts.
  4. Providing advice and consultations in the field of alternative methods of resolving disputes and assisting everyone who requests how to take procedures for resolving disputes using alternative methods of resolving disputes.
  5. Organizing courses on alternative methods for resolving disputes and preparing and accrediting arbitrators, experts and mediators.
  6. Organizing, hosting and holding conferences and workshops on arbitration and alternative dispute resolution methods.
  7. Publishing, printing and preparing studies, magazines, publications and research on alternative methods of resolving disputes.
  8. Providing advice and assistance in implementing national and international arbitration awards.
  9. Establishing a public library in the field of legal knowledge and all knowledge related to arbitration and other methods of resolving disputes

Mission and Structure of the IACS

The IACS is an arbitration institution whose mission is to secure the settlement of sports- related disputes. To this end, it entrusts arbitrators with the task of pronouncing an award.

The IACS comprises four Divisions (the Ordinary Arbitration Division, the Appeals Arbitration Division, the football Arbitration Division and the Private Arbitration Division), all placed under the responsibility of a Division President. Arbitration filed with the CAS is allocated to one or the other Divisions depending on the nature of the dispute between the parties.

Ordinary Arbitration Division
